CONFIDENTIALITY AND RETENTION MANAGEMENT

Tribal administrative support personnel need guidance in procedures for protecting the confidentiality of information within records. Tribal governments are required to establish confidentiality procedures to protect the rights of privacy of individuals under the jurisdiction of the Tribe. Personal rights of privacy are established under constitutional law, the Indian Civil Rights Act and various other federal statutes (Privacy Act, HIPAA, FOIA.) The seminar will outline requirements on how to establish and implement policies for records protection and confidentiality. This training will also examine the requirements of records maintenance and retention, notification procedures, conditions of disclosure, access requirements, Privacy Act exemptions, use and protection of Social Security numbers and medical information security. This course is for all records staff and managers, program managers and personnel department staff.
