Personnel documentation can be a benefit or a
problem to
the Tribe's legal defenses in grievance or labor law actions. Proper personnel
record keeping is the law. The Tribe needs to ensure that its records are in
proper order to comply with the requirements imposed by various labor laws.
There are fines for noncompliance as well as potential losses if the
employer is unable to substantiate an employee action. Federal record keeping
requirements authorize the funding agencies to investigate your
records and record keeping system. Good records can support your employment
decision; improper or lack of records can make you appear guilty. The audit
agencies follow the " best evidence " rule. So if the employer has
incomplete records and the employee has kept their own log, the employee will
likely win the case. Many areas of employer/employee relations are subject to
record keeping requirements. Some of the most commonly litigated areas are payroll,
medical, independent contractor status, and immigration. This seminar will
examine the federal posting requirements, federal and state record keeping
requirements, federal records retention requirements, and personnel file access
