The Department of Labor, the 7th and 9th Circuit Courts
have ruled that Tribes are subject to the Fair Labor Standards Act barring
specific exemptions permitted by the law. In addition to being subject to
the provisions of FLSA, Tribes are also subject to the Contract Work Hours Act
under ' 638 Contracts, which require compliance with the Contract Work Hours Act
and the FLSA. These
two laws govern the wages paid and the hours worked by Tribal employees.
Failure to comply with these laws could result in substantial damages being
levied against the Tribe. This seminar focuses on the provisions of these
Acts and uses case law and sample problem scenarios to illustrate the impact of
each law. This seminar is designed for all Tribal leaders, program
officials, payroll staff and staff subject to overtime.
