A critical issue facing Tribes today is Tribal membership. The procedures for defining Tribal membership are generally
established in the Tribal constitution and Tribal membership ordinance. These
laws and procedures are in turn affected by cultural issues and federal laws.
DNA analysis has allowed Tribal enrollment officials to establish new criteria
for enrollment in a Tribe. The modern science of DNA testing has opened a new
arena within the issue of Tribal enrollment. DNA testing can provide partial evidence for proof of
membership, but there is a huge amount of misinformation that has muddied the
water on this matter. Tribal staff are constantly faced with program eligibility
issues, responsibilities, and needs which are affected by Tribal membership. DNA
testing will be addressed within this context. This seminar addresses how Tribal
membership laws are interpreted and applied, and how DNA analysis can be used in
this process.
