RIGHTS OF WAY AND EASEMENTS - DESCRIPTION AND ANALYSIS
This course is developed so each student can become familiar with and acquire the techniques needed to professionally negotiate for and accept rights of way and easements on Indian lands. Often Tribes are faced with the renegotiation of rights of way which are expiring. The Tribe must be prepared to assert their rights in this process. This seminar will provide an overview of rights of way, the means to assess status, rules of property law, condemnation, trespass, assumption of rights of way, determination of proper compensation and setting terms of agreement and negotiation. Also, the fundamental principles and procedures of Rights of Way acquisitions under BIA regulations will be discussed along with the regulatory impact of Tribal and federal laws. This is a vital course for Tribal natural resource staff, realty/land department personnel and federal real property employees.
