E-VERIFY: ELECTRONIC VERIFICATION OF TRIBAL EMPLOYEES

Tribal Personnel/Human Resource and Procurement staff have new legal requirements and responsibilities. As of September 8, 2009, employers with Federal contracts or subcontracts that contain the Federal Acquisition Regulation (FAR) E-Verify clause are required to use E-Verify to determine the employment eligibility of:

bulletEmployees performing direct and substantial work under those Federal contracts
bulletNew hires Tribal wide - regardless of whether they are working on a Federal contract

Tribes have '638 contracts with BIA, IHS and BOR. Any '638 contract for construction is subject to the FAR clause and thus subject to the E-Verify responsibility. The same clause will be required in subcontracts over $3000 for services or construction. Therefore Tribes must now E-Verify all employees under '638 contracts plus all new hires within the Tribe regardless of which program they work under. The Tribe that has a contract with the FAR E-Verify clause has the option of verifying the Tribe's entire workforce. It also requires Tribal procurement staff to impose the E-Verify responsibility upon all '638 subcontractors.

This new law requires Personnel/HR and Procurement employees using information reported on an employee's Form I-9 to determine the eligibility of that Tribal or subcontractor employee to work in the United States. Completion of Form I-9 (Employment Eligibility Verification) is required by law for all employers.

E-Verify works with and exists to strengthen the Form I-9 process by offering Tribes the ability to compare information that employees provide on the Form I-9 to Social Security Administration and Department of Homeland Security records. E-Verify is a partnership between the Department of Homeland Security (DHS) and the Social Security Administration (SSA). U.S. Citizenship and Immigration Services (USCIS) oversees the program. E-Verify allows participating Tribes to electronically compare employee information taken from the Form I-9 (the paper based employee eligibility verification form used for all new hires) against more than 449 million records in the SSA's database and more than 80 million records in DHS immigration databases. Results are returned in seconds. A Tribe must enroll online and accept the electronic Memorandum of Understanding (MOU) that details the responsibilities of SSA, DHS and the Tribe.

This seminar will examine the roles and responsibilities of Tribal Personnel/HR and Procurement employees in the implementation of the new E-Verify requirement. It is recommended for all Tribal Personnel and Procurement staff.
