Tribes are subject to the Drug Free Work Place
Act, Drug Abuse Office and Treatment Act of 1972, and the
Comprehensive Alcohol Abuse and Alcoholism Treatment and Rehabilitation Act of
1970. These acts require that the Tribe establish policies regarding drug
and alcohol use in the workplace as well as referral procedures. Case law
and these statutes permit the Tribe to conduct drug and alcohol testing.
The seminar will address the types of testing procedures including pre-employment
testing, critical job testing, reasonable suspicion testing and random testing.
It will also describe some of the physiological factors
and effects of various drugs. Finally it will discuss the suggested
screening procedures, the types of drugs which can be screened and testing
sources. This seminar is for Tribal
managers and Tribal personnel staff as well as Tribal casino employees.
